These Terms of Service (“Terms”) govern your use of Get Pool Temp at getpooltemp.com (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Get Pool Temp provides software estimates of outdoor swimming-pool water temperature and related tools (such as evaporation/level estimates and heater scheduling suggestions), based on user inputs and third-party weather data. Optional paid features are offered as Pool Temp Pro.
2. Estimates only — not professional advice
All forecasts, evaporation/level figures, heater runtimes, and party heat plans are approximate models. They are not warranties of actual water temperature, water loss, leak diagnosis, heater behavior, energy cost, or safety.
- Real pools vary with construction, covers, pumps, chemistry, splash-out, rain, and equipment condition.
- Evaporation tools do not certify whether a pool has a leak; use qualified professionals for leak detection and repairs.
- Heater plans are recommendations only. You are responsible for operating heaters and automation safely per manufacturer instructions. The Service does not directly control pool equipment unless a future integration is explicitly offered and accepted under additional terms.
Do not rely on the Service as the sole basis for decisions that could affect safety, property damage, or significant cost.
3. Accounts and free use
You may use free features without a password. Pro access is tied to a Stripe subscription and may be restored on a device using the email address used at checkout. You are responsible for activity under your email and devices.
4. Pool Temp Pro subscriptions
- Plans: as displayed at checkout (e.g. monthly or annual pricing in USD).
- Billing: payments are processed by Stripe. Taxes may apply where required.
- Renewal: subscriptions renew automatically until canceled.
- Cancel: cancel anytime via the Stripe Customer Portal (use Manage on the site after Pro is active, or Restore with your email first). Cancellation typically ends access at the end of the current paid period, unless Stripe or the portal states otherwise.
- Refunds: except where required by law, fees are non-refundable. Contact us if you believe a charge was made in error.
- Feature changes: Pro features may change as we improve the Service; material removals of core paid value may be communicated where practical.
5. Acceptable use
You agree not to:
- Misuse the Service, attempt to bypass payment or security, or reverse engineer except as allowed by law.
- Use the Service for unlawful purposes or to harm others.
- Overload or disrupt our infrastructure or third-party APIs.
- Scrape or resell the Service in bulk without permission.
We may suspend or terminate access for violations or abuse.
6. Intellectual property
The Service, including software, design, and branding, is owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal or internal business purposes under these Terms. Weather data remains subject to third-party terms.
7. Third-party services
The Service depends on third parties (including weather data providers, hosting, and Stripe). We are not responsible for outages, errors, or policies of third parties. Your use of Stripe is also subject to Stripe’s terms.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FORECASTS WILL BE ACCURATE OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR PRO IN THE THREE MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent allowed.
10. Indemnity
You agree to defend and indemnify us against claims arising from your misuse of the Service, your pool equipment decisions, or your violation of these Terms, except to the extent caused by our willful misconduct.
11. Changes to the Service or Terms
We may modify or discontinue features. We may update these Terms; the “Last updated” date will change. Continued use after changes constitutes acceptance. If you disagree, stop using the Service and cancel Pro.
12. Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules, unless mandatory consumer protections in your place of residence require otherwise. Courts in Michigan shall have exclusive jurisdiction, subject to applicable consumer rights.
